Terms of Use

 

Ownership of Site; Agreement to Terms of Use. These terms are effective 1st August 2010
These Terms and Conditions of Use (the “Terms of Use”) apply to the SunQueensland web site located at www.sunqueensland.com, and all associated sites linked to www.sunqueensland.com by SunQueensland, its subsidiaries and affiliates. The Site is the property of Sun Network. BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THE SITE.

 

SunQueensland reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms of Use, SunQueensland grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site.

 

Using SunQueensland. As a condition of your use of SunQueensland you agree that you will not:

 
  • violate any laws;
  • violate the Posting Rules;
  • post any threatening, abusive, defamatory, obscene or indecent material;
  • be false or misleading;
  • infringe any third-party right;
  • distribute or contain spam, chain letters, or pyramid schemes;
  • distribute viruses or any other technologies that may harm SunQueensland or the interests or property of SunQueensland users;
  • impose an unreasonable load on our infrastructure or interfere with the proper working of SunQueensland;
  • copy, modify, or distribute any other person's content without their consent;
  • use any robot spider, scraper or other automated means to access SunQueensland and collect content for any purpose without our express written permission;
  • harvest or otherwise collect information about others, including email addresses, without their consent;
  • by pass measures used to prevent or restrict access to SunQueensland.
 

You are solely responsible for all information that you submit to SunQueensland and any consequences that may result from your post. We reserve the right at our discretion to refuse or delete content that we believe is inappropriate or breaching the above terms. We also reserve the right at our discretion to restrict a user’s usage of the site either temporarily or permanently, or refuse a user’s registration.

 
Content. SunQueensland contains content from us, you, and other users. SunQueensland is protected by copyright laws and international treaties. Content displayed on or via SunQueensland is protected as a collective work and/or compilation, pursuant to copyrights laws and international conventions. You agree not to copy, distribute or modify content from SunQueensland without our express written consent. You may not disassemble or decompile, reverse engineer or otherwise attempt to discover any source code contained in SunQueensland. Without limiting the foregoing, you agree not to reproduce, copy, sell, resell, or exploit for any purposes any aspect of SunQueensland (other than your own content). When you give us content, you are granting us and representing that you have the right to grant us, a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content.

SUNQUEENSLAND DOES NOT PROMISE THAT THE SITE OR ANY CONTENT, SERVICE OR FEATURE OF THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED, OR THAT YOUR USE OF THE SITE WILL PROVIDE SPECIFIC RESULTS. THE SITE AND ITS CONTENT ARE DELIVERED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. ALL INFORMATION PROVIDED ON THE SITE IS SUBJECT TO CHANGE WITHOUT NOTICE. SunQueensland reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the Site, or any portion of the Site, for any reason; (2) to modify or change the Site, or any portion of the Site, and any applicable policies or terms; and (3) to interrupt the operation of the Site, or any portion of the Site, as necessary to perform routine or non-routine maintenance, error correction, or other changes.

 
Indemnity

You agree to indemnify and hold SunQueensland, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against Apple by any third party due to or arising out of or in connection with your use of the Site.

 
Privacy

SunQueensland’s Privacy Policy applies to use of this Site, and its terms are made a part of these Terms of Use by this reference. To view SunQueensland’s Privacy Policy, click here. Additionally, by using the Site, you acknowledge and agree that Internet transmissions are never completely private or secure. You understand that any message or information you send to the Site may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.

 

General. These terms and the other policies posted on SunQueensland constitute the entire agreement between SunQueensland and you, superseding any prior agreements. 
To the extent permitted by applicable law, this Agreement shall be governed and construed in all respects by the laws of Queensland. You agree that any claim or dispute you may have against SunQueensland.com must be resolved by the courts of Queensland. You and SunQueensland both agree to submit to the exclusive jurisdiction of the state of Queensland Courts; for claims falling within the jurisdiction of a Queensland Court, you and SunQueensland both agree to submit to the jurisdiction of the Court of Queensland

 

If we don't enforce any particular provision, we are not waiving our right to do so later. If a court strikes down any of these terms, the remaining terms will survive. We may automatically assign this agreement in our sole discretion in accordance with the notice provision below.

 

Except for notices relating to illegal or infringing content, your notices to us must be sent by registered mail to Suite 3, Level 1, 233 Albert street, Brisbane Queensland, Australia. We will send notices to you via the email address you provide, or by registered mail. Notices sent by registered mail will be deemed received five days following the date of mailing. 

 
We may update this agreement at any time, with updates taking effect when you next post or 30 days after we post the updated policy on the site, whichever is sooner. No other amendment to this agreement will be effective unless made in writing, signed by users and by us.
 
Violation of These Terms of Use
 
SunQueensland may disclose any information we have about you (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Site, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) SunQueensland’s rights or property, or the rights or property of visitors to or users of the Site, including SunQueensland’s customers. SunQueensland reserves the right at all times to disclose any information that SunQueensland deems necessary to comply with any applicable law, regulation, legal process or governmental request. SunQueensland also may disclose your information when SunQueensland determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes.
 
You acknowledge and agree that SunQueensland may preserve any transmittal or communication by you with SunQueensland through the Site or any service offered on or through the Site, and may also disclose such data if required to do so by law or SunQueensland determines that such preservation or disclosure is reasonably necessary to (1) comply with legal process, (2) enforce these Terms of Use, (3) respond to claims that any such data violates the rights of others, or (4) protect the rights, property or personal safety of Apple, its employees, users of or visitors to the Site, and the public.
 

You agree that SunQueensland may, in its sole discretion and without prior notice, terminate your access to the Site and/or block your future access to the Site if we determine that you have violated these Terms of Use or other agreements or guidelines which may be associated with your use of the Site. You also agree that any violation by you of these Terms of Use will constitute an unlawful and unfair business practice, and will cause irreparable harm to Apple, for which monetary damages would be inadequate, and you consent to SunQueensland obtaining any injunctive or equitable relief that Apple deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies SunQueensland may have at law or in equity.

 

You agree that SunQueensland may, in its sole discretion and without prior notice, terminate your access to the Site, for cause, which includes (but is not limited to) (1) requests by law enforcement or other government agencies, (2) a request by you (self-initiated account deletions), (3) discontinuance or material modification of the Site or any service offered on or through the Site, or (4) unexpected technical issues or problems.

 

If SunQueensland does take any legal action against you as a result of your violation of these Terms of Use, SunQueensland will be entitled to recover from you, and you agree to pay, all reasonable attorneys’ fees and costs of such action, in addition to any other relief granted to SunQueensland. You agree that SunQueensland will not be liable to you or to any third party for termination of your access to the Site as a result of any violation of these Terms of Use.

 

SunQueensland Posting Policies

At SunQueensland we want to make sure that the site is as clean, friendly and usable as possible for everyone. Ads that fall outside the posting rules stated in our Help sections or our Terms of Use may be removed from the site.

We reserve the right at our discretion to refuse or delete content that we believe is inappropriate or breaching our terms of use. We also reserve the right at our discretion to restrict a user’s usage of the site either temporarily or permanently, or refuse a user’s registration.
 

General reasons for ad removal or ads being placed on hold

 
  1. Against policy
  2. Duplicate of another ad posted by you
  3. Posted under wrong category (You must choose the single most relevant category for your ad)
  4. No website links to other job / education agency/ classified sites
  5. Inappropriate language
  6. Inappropriate photo / image
  7. Discriminatory on race / religion / nationality
  8. Location, price or URL's in titles
  9. Selling or offering services for supplements/medicine general or pharmaceutical
  10. Selling body parts / bodily fluids, adoption or surrogacy anywhere on the site
  11. Ads that report other fraudulent ads. Please report potentially fraudulent ads via the "report ad" option located within each ad or contact us with ad details (ad id, email address)
 

SunQueensland reserves the right to remove any postings that we feel are not relevant, or of value to the SunQueensland community, with or without notice.
